Terms & Conditions of Sale

GENERAL

Placing with us an order for goods and/or service implies acceptance of the following

Terms & Conditions which may be varied only in writing by this Company’s authorized representative.

  1. Validity
    Unless otherwise stated therein we issue all quotations & tenders subject to confirmation by us on receipt of orders.
  2. PRICE
    Goods quoted are based on cost of production, freight, insurance , exchange , duties & other costs of importation current at the time of quotation.
  3. GST
    Our prices are subject to the addition of GST or other statutory impost if applicable.
  4. PAYMENT
    All prices are net payments prior to delivery unless otherwise stated.
  5. DESPATCH
    We will endeavour to dispatch on the date specified but will accept no responsibility nor shall a contract be cancelled for failure to do so.

    Our handing over of goods ordered to a carrier or other transport body nominated by the customer constitutes delivery and loss or damage after delivery is the responsibility of the customer.

    If our nominated transport body delivers the goods to the customer’s premises our insurance will cover the goods only to the handing over point which is the moment they are lifted from the truck.

    We strongly recommend that the customer insure the goods before they are handed over in either of the events described above.
  6. PRODUCT GUARANTEE
    Warranty ONLY COVERS failures due to defects in materials or workmanship, and DOES NOT COVER normal wear & tear or cosmetic damage. The warranty ALSO DOES NOT COVER damages which occurred in shipment, or failures which are caused by products not supplied by this Company or failures which result from accidents, misuse , neglect, mishandling ,misapplication, alteration, faulty installation, set-up adjustments, maladjustment of controls , improper  maintenance  , power line surge , lightning damage , modification, introduction of dust ,humidity or liquids or service by anyone other than an Authorized Servicer , or damage that is attributable as an act of god.
  7. THIS EXPRESS LIMITED WARRANTY IS IN LIEU OF ALL OTHER  WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABLITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL J C WALSH BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF PRODUCTS OR ARISING OUT OF ANY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY.

    (As examples , this warranty excludes damages for lost time, travel to & from the Authorized Servicer, loss or damage to media or images, data or other memory or recorded content.

    This list of items is not exhaustive, but for illustration only.) In certain instances, some jurisdictions do not allow the exclusion or limitations of incidental or consequential damages, or the exclusion of implied warranties, so the above limitations and exclusions may not be applicable. This warranty gives you specific legal rights and you may have other rights which vary depending on you state or territory. Our guarantees are limited to the full benefits given by our suppliers, plus all statutory warranties provided under the Trade Practices Act and Australian Consumer Law..
  8. DESCRIPTIVE MATTER
    All information contained in drawings , catalogues, price lists, photographs and images and other illustrations of advertising matter represent generally the subject matter but shall not be taken as necessarily representing goods the subject of an order and shall not for part of a contract.
  9. ACCEPTANCE
    Contracts and orders are only accepted upon and subject to this company’s condition of quotation or representation on line, if applicable, and sale is conditional on the Terms & Conditions herein printed and as appearing on line.
  10. CANCELLATION / RETURNS
    Subject to the above conditions any contract of sale arising from a quotation or representation on line will be a firm contract and the buyer shall have no right to cancel except with the consent in writing from this company.
  11. Should the item purchased under a contract of sale be faulty a return can be accepted. Should the purchaser identify the goods a faulty the goods can be returned to JC Walsh where they will be assessed. All costs for the return and pick up are to be borne by the purchaser.
  12. PROPERTY
    The goods remain the property of J C Walsh until full payment is received.

Privacy Policy

JC Walsh Machinery Sales and Service does not intentionally collect and store private details of customers for any purpose other than pertaining to a particular machinery sale, part sale or service work.

Personal emails and contact numbers are generally recorded during sales activity either on line or in person. This information is used to contact the customer regarding delivery, operation and general communication related to that particular sale. This information is used for no other purpose.

No personal information is transferred or sold on to any other entity.

Our website does use Cookies and any information received is secure via internet firewall systems. However the website owner disclaims liability for site intrusion and site intrusion with malicious intent.

No third party advertising will occur on our website.
